TERMS OF USE OF THE “TENDER” MODULE
1. Terminology
Platform – www.allfoods.market website
Seller – a legal entity registered and placing its goods on the platform for the purpose of sale
Buyer – a legal entity registered on the platform for the purpose of purchasing goods posted on the platform by Sellers.
Tender – section (module) on the platform, with the help of which the Buyer can fill out an application for the required product and receive optimal offers from several Sellers.
2. General terms
2.1. The platform does not provide the «Secure deal» service in the “Tender” module. All interactions between the Buyer and the Seller, including financial settlements, take place directly between the parties to the deal.
2.2. For each product, the Buyer can create only 1 (one) tender
2.3. All applications for “Tender” are received by all registered Sellers, regardless of the goods they display on the platform.
2.4. All conditions for the delivery and acceptance of goods purchased through the Tender section are discussed by the Buyer directly with the Seller. The Platform does not take part in organizing the shipment/delivery process and is not legally responsible for the failure of the Buyer and Seller to fulfill their obligations to each other.
3. Terms of use of the “Tender” module for the Buyer
3.1. The buyer independently decides for which goods to create a “Tender”.
3.2. The number of applications submitted within the Tender module is not limited.
3.3. Filling out applications within the “Tender” module is free for the Buyer.
3.4. When creating an application, it is necessary to indicate the date until which Sellers can send their commercial proposals within the framework of the “Tender” module.
3.5. The Buyer has the opportunity to accept one or more offers within a particular “Tender” and enter into a deal with several Sellers accordingly. The Buyer also has the opportunity to reject commercial offers that are unsuitable at his discretion.
3.6. All current and past “Tenders”, along with commercial offers from Sellers, are stored in the “Tender” section in the Buyer’s personal account on the platform.
4. Terms of use of the “Tender” module for the Seller
4.1. The number of proposals in “Tenders” is limited by limits within the terms of the account used. Information on limits is available in the Seller’s personal account.
4.2. If the limit of proposals for participation in “Tenders” is exhausted, the seller can increase his limit by selecting an account of a different level or purchase an additional number of participations (for an Enterprise account) by contacting the platform support service through the feedback form.
4.3. The seller independently makes a decision regarding participation in the announced “Tender” and may not send a commercial offer if the conditions of the tender application are not suitable for him or if the goods in the tender application do not correspond to the range of his products.
4.4. For one tender, the Seller can create several proposals with different conditions (cost, delivery date, quantity), within the limit available to him.
4.5. All current and past “Tenders” with commercial proposals are stored in the “Tender” section in the Seller’s personal account on the platform.
